Applicability of the State Historical Building Code (SHBC)

The SHBC defines Qualified Historical Building or Property as "Any building, site, structure, district, or collection of structures, and their associated sites, deemed of importance to the history, architecture, or culture of an area by an appropriate local, state or federal governmental jurisdiction."

Alameda Municipal Code Section 13-21-7 (a) states, “Any building that was constructed prior to 1942 shall not be demolished or removed without the approval of a certificate of approval issued by the Historical Advisory Board. The age of the building shall be determined by a review of the City records.”

Buildings built prior to 1942 meet the State definition of Qualified Historical Building by virtue of being required to obtain a Certificate of Approval from the HAB.

Therefore, any building built prior to 1942 may take advantage of the SHBC. Additionally, all buildings on the City of Alameda Historical Building Study List are also subject to the SHBC.

Buildings covered by the SHBC are exempt from Title 24 Energy Code requirements, this includes all buildings built prior to 1942.
